Terms of Service

These Terms of Service ("Terms") govern your use of BluePomodoro (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Who can use the Service

You must be at least 14 years old to use BluePomodoro. By using the Service you confirm that you meet this requirement and that you will comply with these Terms and applicable law.

2. Your account

You sign in through a third-party provider (Google, Apple, Discord or X). You are responsible for keeping access to your account secure and for all activity that happens under it. You must not share your account or use the Service to harm others.

3. Plans, prices and payments

• The Service is free to use with certain limits. Pro is a paid subscription that removes those limits.
• Prices are shown in the app before you pay (for example, €9.90 per month or €97 per year, or the equivalent nominal amount in US dollars).
• Payments are processed by Stripe. We do not store your card details.
• Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account settings; you keep access until the end of the period you have already paid for.
• Free trial. New accounts may be offered a 14-day Pro trial. Trials are limited to one per person and are not renewed automatically into a paid plan unless you subscribe.
• AudioWheels. Individual AudioWheels can be bought once for €1.99 (or the equivalent nominal amount in US dollars). A purchased AudioWheel stays available on your account permanently, even if you do not have an active subscription.

4. Refunds

Because the Service is digital and delivered immediately, payments are generally non-refundable except where the law requires otherwise. If you are a consumer in the EU, you have a 14-day right of withdrawal for digital content, but this right is lost once the content is supplied with your prior consent and acknowledgement. If something went wrong, contact us and we will do our best to help.

5. Free limits and Pro

The free plan includes the following limits:

When you reach a free limit, the Service will invite you to try Pro or subscribe. Limits may be adjusted over time; we will show the current limits in the app.

6. Acceptable use

You agree not to:

• use the Service for unlawful purposes or to infringe others' rights;
• upload illegal, harmful or infringing content;
• attempt to bypass limits, trials or security measures, or access data that is not yours;
• disrupt or overload the Service or its infrastructure.

7. Your content and intellectual property

You keep ownership of the content you create. You grant us the limited rights needed to store, process and display it in order to provide the Service. The Service itself, including its software, design and audio content, belongs to us or our licensors and may not be copied or redistributed except as allowed by law.

8. Availability and changes

We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may change, suspend or discontinue features, and we may update these Terms. Material changes will be announced in the app.

9. Liability

To the extent permitted by law, the Service is provided "as is" and we are not liable for indirect or consequential damages, or for loss of data that you have not exported. Nothing in these Terms limits rights you have as a consumer under mandatory law.

10. Termination

You can stop using the Service and delete your account at any time from your account settings. We may suspend or terminate accounts that violate these Terms.

11. Governing law

These Terms are governed by the laws of Spain. If you are a consumer, you may bring proceedings in the courts of your place of residence.
